Using "illegal" Subcontractors Makes You a Target for Prosecution

Of all the employment issues we advise our clients on, the subject of proper hiring practices is becoming more and more critical. Just the other day in Des Moines, Iowa, 390 people were arrested for immigration violations at a meatpacking plant. According to ICE (US Immigration and Customs Enforcement) this was the largest workplace raid in US history. The Associated Press reports that the raid was aimed at seeking evidence of identity theft, stolen Social Security numbers, and people who are in the country illegally.

While the politicians wrestle with what to do about illegal immigrants, Homeland Security has announced a “comprehensive immigration enforcement strategy for the nation’s interior.” In 2007 alone ICE “dramatically increased penalties against employers whose hiring processes violate the law, securing fines and judgments of more than $30 million while making 863 criminal arrests and 4,077 administrative arrests.” According to Julie Myers, head of ICE, “ICE has no tolerance for corporate officers who harbor illegal aliens for their work force.”

OK. I can hear you saying, “I don’t hire illegal aliens! So why should this matter to me or my company?” While it is obvious that hiring employees who are in the country illegally is a crime, you may not know that using illegal subcontractors can also subject you to the same punishment.

YOU BETTER KNOW WHO YOUR SUBCONTRACTORS ARE!

As you may know, Walmart was just was recently fined $11 million dollars for using subcontractors that had hired illegals. Why? Because it is alleged that a few Walmart managers knew that some of the subs were not here legally. If someone in your company’s management knowingly hires a subcontractor who uses illegals, your company will be subject to civil penalties. Furthermore, you will probably end up getting really bad press!

CAN YOU SAY RACIAL PROFILING?

Because law enforcement hates to be accused of racial profiling, I can almost guarantee that at some point, a few businesses who have never hired anyone outside of a 5 mile radius will still be investigated. How will they investigate? Almost certainly someone will be sent to your company to peruse your I-9 forms. Because an employee must place his social security number on an I-9 form, examining these forms allows ICE to see if any of your employees are using a false social security number. A smoking gun.

CHECK YOUR EMPLOYMENT FILES - NOW!

Current law requires that all employees correctly and fully complete an I-9 form upon being hired. Not retaining forms or not having forms completed correctly can subject your business to fines. If you’ve ever needed some “encouragement” to double check your files, NOW IS THE TIME TO GET YOUR RECORDS IN ORDER.

BUT I DON’T COLLECT I-9 FORMS FROM MY SUBCONTRACTORS

Most companies don’t because they’re not required to. However, in light of the Walmart case, best practices may dictate that you start. If ICE ever does investigate your company, you can show that not only do you not hire illegal aliens; you go the extra mile to make sure your subs are not illegal either.

As the stepped up law enforcement surrounding this issue shows, it’s not going to go away any time soon. Therefore, our duty as risk managers and insurance agents is to keep our clients informed about these types of developments so we can help protect them from all of the risks they face.

Ford Motor Company 1908-2009

Are we about to witness the death of Ford Motor Company?

Ford incorporated the Ford Motor Company in 1903, proclaiming, “I will build a car for the great multitude.” In October 1908, he did so, offering the Model T for $950. In the Model T’s nineteen years of production, its price dipped as low as $280. Nearly 15,500,000 were sold in the United States alone. The Model T heralds the beginning of the Motor Age; the car evolved from luxury item for the well-to-do to essential transportation for the ordinary man.

Ford revolutionized manufacturing. By 1914, his Highland Park, Michigan plant, using innovative production techniques, could turn out a complete chassis every 93 minutes. This was a stunning improvement over the earlier production time of 728 minutes. Using a constantly-moving assembly line, subdivision of labor, and careful coordination of operations, Ford realized huge gains in productivity.

For everything Ford has done for the automobile industry, and Michigan, Ford is on it’s death’s door.

Japanese auto maker Toyota, is ready to shovel the dirt into Ford’s grave. It’s new 2008 Toyota Tundra is set to dethrone the king of trucks with it’s newest model of the Tundra.

I am not into cars or trucks, but I had an interesting conversation with a friend whom works for a Toyota Dealership, actually the second largest Toyota dealership in the world. he states that the Japanese auto maker is ready to capitalize on America’s appetite for foreign cars and now trucks.

Toyota is betting that it’s new Tundra and now the Hybrids, which neither one can remain in stock, will be the nail into Ford’s coffin and soon Chrystel and American icon General Motors.

How sad it is that us selfish Americans are putting our own country to sleep with our insatiable appetite for foreign goods.

I think that that our children should be learning Chinese and Japanese in our schools instead of Spanish. We will need such languages when our government is overthrown but the new super powers after our economy crashes our our appetite.

Hell, we have been a country of over eaters (look at all the fat asses) for decades now anyways, why not gorge ourselves to death on an Japanese diet of Toyota and a nice buffet of Chinese “Walmart”?

I think the killers that we dubbed the “Sniper Killers” the ones that drove around with the kid in the trunk shooting at pedestrians from the keyhole in the trunk at various stores and highways should be released by the government and be permitted to “shop” for customers at these foreign dealerships and “Walmarts” of the world.

It will not belong, but maybe after Clinton in 2012, we hungry Americans will be ready to elect

Toshiaki “Tag” Taguchi, President of Toyota or Jiang Zemin, President of China as our next leader.

If we do not get off our selfish asses, this is exactly what will happen. “Buy American, or Die”

Businesses Come to Myspace

MySpaces notoriety is truly phenomenal. MySpace is familiar, literally, to people in every corner of the world. This level of recognition might seem to be something admirable or coveted. Further thought about things however might bring about a different perspective. Time and again famously popular brands have seen their appeal plummet back to earth. Theres a fine line in other words between popularity and overexposure. It seems that at some point, people just get plain tired of seeing or hearing about the same old thing.

In the case of MySpace, what was once mostly a virtual gathering spot for teens has been covered from every different angle by the mass media. The media came and told MySpace’s story to millions of people throughout the world. This is the nature of the media, after all. The appearance of the media in MySpace land however may have given core MySpace users the impression that their territory had been intruded upon, and even sold out to mainstream interests.

The feeling of MySpace going corporate may have left a particularly significant impression on MySpace users. Burger King and WalMart, two big companies if there ever were any, once had profiles on MySpace. Both profiles have since been abandoned and at least in WalMart?s particular case their MySpace profile seems to have been removed in response to bad publicity. It seems many MySpace users were not happy with WalMart?s presence on MySpace, and expressed as much through harsh comments left on WalMart?s MySpace profile. So the profile is now gone.

The WalMart scenario may have been a lesson not just that for that company, but for MySpace as well. MySpace has apparently been surpassed in popularity by Facebook, the networking site explicitly for students. Is this due to the general feeling that MySpace had become overrun and corrupted by commercial interests? It?s a possibility certainly. It?s notable that Facebook does show advertising, but under the Facebook format corporate profiles are not allowed: not yet anyway. Perhaps users of any online site have accepted seeing advertising, but not the notion of embracing advertisers as regular members of the community.

All of this isn?t to suggest that MySpace is now somehow irrelevant: there are still hundreds of millions of MySpace profiles, and almost certainly millions and millions of MySpace members. But if there is something to be taken from the response to corporate presences on MySpace it may be that business sites should be presented with a light touch and without an obvious motivation to increase sales or to generate publicity. As with any other community, becoming an accepted part of MySpace takes time and a respectful effort.
